1. Scope and Operator#

Central Bible University ("CBU," "we," "us," or "our"), located at 911 E Urbandale Dr., Moberly, Missouri 65270, operates the CBU Campus App. This Privacy Policy explains how the app collects, uses, discloses, retains, and protects information when an eligible person uses the app in the United States.

The app is a private campus service for people with a valid @centralbible.edu email address. It is not intended for children under 13. Some eligible students may be under 18.

App terminology#

The app may use "Saint" or "Saints" as a branded name for an ordinary verified CBU Campus App user or for features available to those users. The term does not identify a separate organization, third party, legal status, religious determination, or additional category of person or personal information. In this Privacy Policy, references to a "user" include a person the app may label as a "Saint."

2. Information We Collect#

Account and campus identity information#

We collect information used to create, verify, administer, and secure an account, including:

  • first and last name, display name, and CBU email address;
  • authentication provider and email-verification status;
  • campus role and app permissions;
  • optional graduation year and profile biography;
  • roster status, student or campus ID number, and account-to-roster linkage;
  • account status, including active, inactive, suspended, or deleted status; and
  • account creation, sign-in, profile-update, and administrative timestamps.

CBU may obtain roster and campus ID information from authorized institutional records and link it to an app account using the account's CBU email address.

Photos and uploaded files#

Depending on the features a user chooses, we may collect:

  • a public Directory profile photo;
  • a private Saints ID photograph—the app's name for a user's private digital ID photo—used for staff scanning;
  • a separate Saints Faces photograph used in the app's optional user name-and-photo matching activity; and
  • images attached to eligible user-created content, such as marketplace listings.

The Saints ID photograph is intended to remain private to the account holder except when the user chooses to display it to authorized CBU personnel for scanning. The Saints Faces photograph is used only in the opt-in Saints Faces activity and is separate from the public profile photograph. These branded feature names refer to app users as explained under App terminology above.

Active campus users may choose whether their profile appears in the campus Directory. Turning Directory listing off hides the profile from Directory browsing and search, but does not change roster status, attendance records, messaging eligibility, roles, or other CBU-controlled institutional records.

Communications and user-generated content#

We collect content and related metadata when users participate in app features, including:

  • public channel posts, threads, replies, reactions, and prayer acknowledgments;
  • prayer requests and updates;
  • marketplace listings and attached images;
  • direct and group messages, conversation titles, participants, reactions, and message status;
  • reports, blocks, moderation actions, and content visibility status; and
  • timestamps, author or participant identifiers, and other information needed to operate and moderate these features.

Users should not submit information about another person unless they are authorized to do so. Prayer requests and free-form communications may reveal sensitive personal, religious, or other information chosen by the user.

Attendance, roster, and campus points information#

We collect and process information needed for approved campus attendance and points programs, including:

  • event or session name, type, date, check-in and check-out status, and scan timestamps;
  • scanned student or campus ID number, roster match, name, email, and linked account identifier;
  • scanner or administrator identity and relevant audit information;
  • points awarded, available balance, transactions, redemption station, receipt identifier, and balance before and after redemption; and
  • steward identity and summary or export status.

Attendance information may be exported to authorized CBU Google Sheets for Student Services. Redemption summaries may be made available to authorized Central Cafe, Concessions, and Bookstore personnel.

Roster, student or campus ID, attendance, points, redemption, and related audit information are CBU-controlled institutional records. They are maintained separately from a user's optional app profile so CBU can accurately administer required campus activities, document participation, maintain student records, and audit points and redemptions. App users cannot change or delete these institutional records through profile settings or account deletion.

Device and notification information#

If a user enables notifications, we collect a push-notification token, device name, device platform, notification preferences, and related timestamps. Users may decline notification permission and continue using the app, and may change notification preferences in the app or device settings.

Technical information#

Our service providers may process technical information necessary to authenticate users, transmit requests, prevent abuse, deliver content, diagnose failures, and secure the service, such as network requests, IP addresses, device or operating-system information, authentication tokens, and service logs. The app does not presently use behavioral advertising, cross-app tracking, or an in-app behavioral analytics or advertising SDK.

3. Device Permissions#

The app may request:

  • Camera access to scan CBU ID barcodes for attendance and point-related features.
  • Photo-library access when a user chooses a profile, Saints ID, Saints Faces, or content image.
  • Notification permission to deliver optional campus announcements, event notices, replies, messages, marketplace notices, or prayer-request updates.

The app does not require microphone access. Permissions may be denied or revoked through device settings, although the related optional feature may then be unavailable.

4. How We Use Information#

CBU uses information only to operate, administer, secure, and improve the campus service, including to:

  • verify eligibility and provide authenticated access;
  • maintain profiles, the campus Directory, roles, and preferences;
  • operate announcements, events, campus resources, messaging, channels, Saints Faces, and Saints ID;
  • administer attendance, roster matching, campus points, and redemption programs;
  • deliver requested notifications;
  • detect, review, and respond to safety, conduct, abuse, and policy concerns;
  • enforce access controls and protect users and CBU systems;
  • troubleshoot failures and maintain reliable service;
  • produce authorized institutional reports and audit records; and
  • comply with applicable law, legal process, and institutional obligations.

CBU does not sell personal information. CBU does not use app information for third-party advertising, behavioral advertising, data-broker activity, or marketing, fundraising, recruitment, research, or promotional use.

5. How Information Is Shared#

Information is shared only as needed to operate the app or meet legal and institutional obligations.

Within Central Bible University#

Access is limited according to role and operational need. Authorized recipients may include Student Services, Herald administrators, Crimson Fire moderators, Attendance Administrators and Scanners, Stewards, Central Cafe personnel, Concessions personnel, Bookstore personnel, and other authorized CBU staff responsible for the relevant service.

Directory information and eligible public content may be visible to other verified CBU app users. Direct and group messages are visible to their participants and may be accessible to authorized personnel when necessary for moderation, safety, security, legal compliance, or investigation.

Service providers#

CBU uses service providers to host and operate the app, including:

  • Google Firebase and Google Cloud for authentication, databases, file storage, backend functions, and infrastructure;
  • Google Drive and Google Sheets for authorized attendance and redemption exports;
  • Expo Application Services for app builds, updates if enabled, and push-notification delivery;
  • Apple services for iOS distribution and notification delivery; and
  • Google services for Android distribution and notification delivery.

The app may open external CBU-approved links, including Google Forms, Google Calendar, and other campus resources. Information a user submits directly on an external service is governed by that service and the organization operating the linked form or page.

CBU requires third parties that process app information on CBU's behalf to protect it consistently with this policy and applicable requirements. We may also disclose information when reasonably necessary to comply with law or legal process, protect safety or rights, investigate misconduct, or respond to an emergency.

6. Public, Private, and Administrative Visibility#

  • Public profile information is visible only to verified CBU app users and is subject to roster and account-status controls.
  • Saints ID images are private account data and are not placed in the Directory, messaging, public profile pages, or Saints Faces.
  • Saints Faces images are used only for the opt-in game and related moderation.
  • Prayer requests, marketplace listings, public threads, and replies are visible according to their channel and expiry settings.
  • Direct and group messages are not public, but are retained and may be reviewed for authorized safety, moderation, security, legal, or investigative purposes.
  • Administrative, roster, attendance, points, redemption, moderation, and audit records are restricted to authorized roles.

7. Retention#

CBU retains information only for as long as reasonably necessary for the purposes described in this policy, subject to legal holds and applicable institutional or legal requirements. The following schedule is proposed for institutional and legal approval:

Moderation reports, investigation records, and related evidence 7 years after closure, or longer during a legal hold or active matter

When a retention period expires, information will be deleted, anonymized, or aggregated unless continued retention is required or permitted by law.

8. Account Deletion and Privacy Choices#

Users may initiate permanent account deletion in the app by opening My Account, selecting Privacy & Delete Account, and following the confirmation steps. Deletion is automatic once confirmed.

Account deletion removes the authentication account, user-facing profile and directory indexes, notification tokens, profile photo, private Saints ID photo, Saints Faces profile and photo, app preferences, and the points balance displayed in that deleted user profile. Public posts are hidden and relabeled. Marketplace evidence retained for safety is moved to restricted storage.

Deleting an app account does not delete, alter, unlink, or anonymize CBU-controlled institutional records, including roster membership, student or campus ID records and roster linkage, required-activity attendance scans, attendance sessions and exports, point transactions, redemption receipts and summaries, moderation and safety records, or administrative audits. The underlying point transactions remain even though the balance displayed in the deleted app profile is removed. These records are maintained independently for campus operations, required-activity accountability, student records, safety, transaction reconciliation, and applicable institutional or legal obligations.

The account-deletion feature gives a user no ability to edit or delete institutional roster, attendance, points, redemption, moderation, or audit records. Access to create or change those records is limited to authorized CBU personnel and protected backend services according to assigned roles. If a former user later creates a new app account, any restoration or reconciliation of institutional records or a points balance must be handled under CBU's authorized administrative process; it is not controlled by the user.

CBU may retain de-identified or restricted records needed for moderation, safety, participant continuity, attendance or transaction audits, administrative accountability, legal compliance, dispute resolution, or legal holds, as described above. Retained records are not used for advertising or marketing. Some content already received by another message participant may remain in that participant's conversation history.

Users may remove optional photos, change profile information, opt out of Saints Faces, change messaging and notification preferences, revoke device permissions, or contact privacy@centralbible.edu with a privacy question or a delete account request. CBU may need to verify the requester's identity before fulfilling certain requests.

9. Security#

CBU uses administrative, technical, and access-control measures designed to protect information, including verified-domain authentication, role-based database and storage rules, restricted administrative tools, encrypted network transmission provided by platform services, and limited access to private and institutional records. No system can guarantee absolute security. Users should protect their credentials, use an appropriate device passcode, and promptly report suspected unauthorized access.

10. Children and Students Under 18#

The app is not directed to children under 13, and CBU does not knowingly permit a person under 13 to create an account. Eligible CBU students may occasionally be under 18. Their information is handled for the campus and educational purposes described in this policy. A parent, guardian, or eligible student with questions may contact privacy@centralbible.edu.

11. United States Availability#

The app is offered only in the United States and its information is processed in the United States or other locations where CBU's service providers operate, subject to their contractual and legal safeguards.

12. Changes to This Policy#

CBU may update this policy when app features, practices, or legal requirements change. We will update the "Last updated" date and provide additional notice through the app or another appropriate channel when a change is material. Continued use after the effective date of an updated policy is subject to the updated policy, except where additional consent is legally required.

Please read these Terms carefully. By creating an account, selecting “I Agree,” or continuing to use the CBU Campus App after these Terms are presented to you, you agree to follow these Terms and applicable CBU policies. If you do not agree, do not use the app.

1. About These Terms#

Central Bible University ("CBU," "we," "us," or "our"), located at 911 E Urbandale Dr., Moberly, Missouri 65270, operates the CBU Campus App (the "App"). These Terms of Use ("Terms") govern access to and use of the App, including its campus information, Directory, messaging, public channels, marketplace, prayer-request, attendance, campus-points, Saints ID, Saints Faces, notification, and administrative features.

The App may use "Saint" or "Saints" as a branded name for an ordinary verified App user or for features available to users. The term does not identify a separate organization, third party, legal status, or religious determination. References in these Terms to a "user" include a person the App may label as a "Saint."

These Terms supplement other CBU rules that apply to a user, including applicable student, employee, conduct, technology-use, safety, academic, housing, and campus policies. They do not replace those rules. If a conflict exists, CBU will interpret and apply the documents according to applicable law and the authority assigned to each policy.

The CBU Campus App Privacy Policy separately explains how CBU collects, uses, shares, retains, and protects information. Accepting these Terms does not replace any consent or notice required by the Privacy Policy or applicable law.

2. Eligibility and Access#

The App is a private campus service. To use it, you must:

  • be eligible for access as determined by CBU;
  • use a valid @centralbible.edu email address;
  • complete required account and email-verification steps;
  • provide accurate account information;
  • use only your own account; and
  • comply with these Terms and applicable CBU policies.

Some features are available only to active campus members, roster-linked users, or users assigned a specific role. CBU may change feature eligibility when a user's enrollment, employment, campus relationship, roster status, assigned duties, account status, or legal eligibility changes.

The App is not directed to children under 13. Eligible CBU students may be under 18. A minor who uses the App remains subject to these Terms and applicable CBU policies, and CBU may provide additional notices or obtain authorization where required by law.

Access to the App is a limited campus privilege, not a guaranteed or permanent entitlement. CBU may limit, make read-only, suspend, or end access as described in these Terms.

3. Account Responsibilities#

You are responsible for activity performed through your account. You agree to:

  • keep your password and device access secure;
  • use a device passcode or other reasonable device protection;
  • not share your account, password, verification link, push token, Saints ID, or student ID barcode for another person to use;
  • promptly report suspected unauthorized access;
  • keep required account information reasonably accurate; and
  • sign out or secure your device when another person could access the App.

You may not create an account for another person, impersonate another person, misrepresent your affiliation or role, or attempt to obtain permissions you were not assigned. CBU may rely on account and device activity as associated with the signed-in account unless CBU determines otherwise.

4. Limited Permission to Use the App#

Subject to these Terms, CBU grants you a limited, personal, revocable, nonexclusive, nontransferable permission to install and use the App on devices you own or control for authorized CBU campus purposes.

You may not:

  • sell, rent, lease, sublicense, redistribute, or commercially exploit the App;
  • copy, modify, reverse engineer, decompile, disassemble, or attempt to derive source code except where applicable law expressly permits it;
  • bypass authentication, access controls, security rules, feature restrictions, or rate limits;
  • probe, scan, or test the App or its infrastructure without written authorization;
  • use automated tools to scrape, harvest, index, monitor, or extract App content or user information;
  • introduce malware, harmful code, excessive traffic, or another disruption; or
  • use the App to build or train an unrelated product, directory, identity system, or dataset.

CBU and its licensors retain all rights not expressly granted.

5. Community Standard and Acceptable Use#

The App is intended to support safe, respectful, campus-related communication and services. CBU does not tolerate objectionable content or abusive users.

You must treat other users, CBU personnel, and community members with dignity and respect. You may not use the App to create, upload, send, request, promote, organize, or distribute content or conduct that:

  • is unlawful or encourages unlawful activity;
  • threatens, glorifies, facilitates, or credibly promotes violence or physical harm;
  • encourages self-harm or gives instructions intended to facilitate self-harm;
  • bullies, harasses, stalks, intimidates, humiliates, exploits, or targets another person;
  • is hateful, discriminatory, demeaning, or abusive toward a person or group based on a protected or sensitive characteristic;
  • is pornographic, sexually explicit, sexually exploitative, or intended for sexual solicitation;
  • depicts, promotes, facilitates, or seeks the sexual exploitation or abuse of a minor;
  • shares another person's private, confidential, medical, financial, educational, location, contact, identification, or intimate information without authorization;
  • impersonates another person or misrepresents identity, authority, affiliation, facts, or the source of a communication;
  • is fraudulent, deceptive, defamatory, extortionate, or intended to manipulate, scam, or improperly obtain money, credentials, goods, services, points, attendance credit, or access;
  • infringes copyright, trademark, privacy, publicity, or other rights;
  • is spam, chain messaging, unauthorized advertising, unauthorized fundraising, or repetitive disruption;
  • contains malware, credential-harvesting material, malicious links, or instructions to compromise an account, device, or system;
  • interferes with App operation, moderation, reporting, security, or another user's access;
  • attempts to evade a block, content restriction, suspension, roster restriction, or other protective measure;
  • knowingly makes a materially false report or abuses reporting tools to target another person; or
  • otherwise violates applicable CBU policy or creates a material risk to users, CBU, or the campus community.

Context matters. Educational, pastoral, safety, or support-oriented discussion of a difficult topic is not automatically prohibited, but it must not be used as a pretext for harm, harassment, exploitation, or prohibited instructions.

6. Feature-Specific Rules#

Public channels, threads, and replies#

Use public channels only for their stated purpose. Marketplace and Prayer Requests are not general-purpose discussion channels. Do not post duplicate, misleading, off-topic, or unauthorized commercial content. Thread owners may close their own threads, but closing a thread removes it from normal visibility rather than guaranteeing permanent deletion.

Direct and group messages#

Direct and group messages are intended for authorized campus communication. They are not public, but they are not guaranteed to be confidential from CBU. CBU may preserve and review messages when reasonably necessary for moderation, safety, security, legal compliance, institutional obligations, or an investigation. Do not use messages to evade a public-channel rule, user block, moderation action, or CBU policy.

Marketplace#

The Marketplace is a campus listing feature, not a payment processor, escrow service, delivery service, or guarantor of a transaction. Users are responsible for evaluating listings and exchanges.

You may not list or request illegal goods or services, weapons, controlled substances, alcohol, tobacco or nicotine products, stolen property, counterfeit goods, sexually explicit materials, unsafe products, academic cheating services, access credentials, student IDs, or anything prohibited by CBU policy. Do not send money or sensitive financial information through App messages. CBU may remove a listing or restrict Marketplace access when it presents a safety, legal, fraud, or policy concern.

Prayer Requests#

Prayer Requests are visible according to the channel's settings. Do not disclose another person's sensitive information without permission. The feature is not a confidential counseling, medical, mental-health, emergency, or crisis service. If someone may be in immediate danger, contact emergency services or the appropriate CBU safety resource rather than relying on the App.

Directory, profile photos, Saints ID, and Saints Faces#

Directory and profile information is provided for authorized campus connection. You may not scrape, republish, sell, use for surveillance, or use it to harass, rank, shame, or objectify another person.

Saints ID is the App's name for a user's private digital ID photo. Do not copy, capture, share, or use another person's Saints ID or student ID barcode without authorization.

Saints Faces is an optional user name-and-photo matching activity. Participation does not authorize another user to download, republish, ridicule, manipulate, or use a participant's photo outside the feature. Users may report an inappropriate or inaccurate photo.

Attendance and campus points#

Attendance, roster, student ID, points, redemption, receipt, and audit features support CBU institutional operations. You may not:

  • scan or present another person's ID or barcode;
  • arrange a false check-in, check-out, attendance record, point award, or redemption;
  • alter, conceal, duplicate, or falsify a transaction or receipt;
  • share scanner, Steward, Attendance Admin, or Herald access;
  • use an assigned role outside your authorized duties; or
  • interfere with an attendance, points, redemption, or audit record.

The App display may not be the final authority if a record is under review. CBU may correct errors and reconcile institutional records through its authorized administrative process.

Announcements, events, resources, reservations, and external links#

Official content may be changed, corrected, delayed, or withdrawn. Users remain responsible for following authoritative CBU instructions and deadlines. The App may open third-party or CBU-managed forms, calendars, websites, maps, or services. Separate terms and privacy practices may apply to those services.

7. User Content and Permission to Operate the Service#

"User Content" includes information, text, images, listings, prayer requests, messages, replies, reactions, reports, profile material, and other content a user submits through the App.

You retain any ownership rights you have in your User Content. You represent that you have the rights and permissions needed to submit it and that its use as described in these Terms does not violate another person's rights.

You grant CBU a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, format, back up, moderate, restrict, preserve, and otherwise use User Content only as reasonably necessary to:

  • operate and provide the App;
  • display content to the audience selected by the feature;
  • maintain security, continuity, backups, and technical functionality;
  • investigate reports and enforce these Terms or CBU policy;
  • protect users, CBU, and the public;
  • maintain authorized institutional and audit records; and
  • comply with law, legal process, or institutional obligations.

This license continues for retained copies and records as described in the Privacy Policy, even if content is hidden or an account is deleted. CBU does not receive ownership of User Content through this license.

You understand that other users may see, quote, react to, respond to, or retain content made available to them. Do not submit content you are not authorized or prepared to share with the feature's intended audience.

8. Reporting, Blocking, and Safety#

Use the App's available Report control to report objectionable content, conversations, or photos. Use the Block control to stop an abusive user from initiating direct messages where that control is available.

Blocking is a personal messaging control. It does not necessarily:

  • remove the blocked person from the Directory;
  • hide all of the person's public content;
  • suspend either account;
  • remove shared group conversations; or
  • notify CBU that a safety review is needed.

Submit a report separately when CBU should review conduct or content. Do not make reports you know are false or use reporting to harass another person.

Reports are not an emergency service. If there is an immediate threat to life or safety, contact 911 or the appropriate CBU emergency or safety resource. CBU may refer a matter to law enforcement, emergency services, campus officials, or another appropriate authority when reasonably necessary.

9. Moderation and Content Actions#

CBU may review reports and may use automated or manual controls to protect the App and campus community. To the extent permitted by applicable law and CBU policy, CBU may:

  • decline, limit, filter, hide, remove, preserve, or restore User Content;
  • lock or close a thread;
  • limit a feature or communication pathway;
  • block an upload or message;
  • preserve a restricted copy for safety, moderation, records, or legal purposes;
  • issue a warning or request corrective action;
  • change an account to read-only status;
  • suspend or end account access; and
  • refer conduct to the appropriate CBU office or outside authority.

CBU is not required to publish moderation evidence, reporter identities, confidential records, security details, or information that could compromise another person's privacy or safety.

Failure to remove content immediately does not mean CBU approves it. Moderation decisions may be revised when additional information becomes available.

10. Read-Only Status, Suspension, and Removal#

CBU reserves the right to deny, restrict, suspend, or permanently terminate a user's access to some or all of the App, and to remove a user from the App, with or without advance notice, to the fullest extent permitted by applicable law and CBU policy. CBU may take such action when it reasonably determines that:

  • the user violated these Terms or another applicable CBU policy;
  • content or conduct presents a safety, security, legal, privacy, fraud, or operational risk;
  • the account appears compromised, shared, fraudulent, or used without authorization;
  • the user attempts to bypass access, moderation, roster, attendance, points, or security controls;
  • the user's CBU relationship, roster status, role, authorization, or eligibility changed;
  • action is needed to investigate a report or preserve evidence;
  • action is required by law, legal process, institutional obligation, or an app-store/platform requirement;
  • continued access may harm another person, CBU, the App, or its service providers; or
  • CBU discontinues or materially changes the App or a feature.

Action may be immediate and without advance notice when CBU reasonably believes delay could create risk, compromise an investigation, permit continued abuse, or violate an obligation. When appropriate and reasonably practical, CBU may provide notice of the account status or a general reason. CBU may withhold details necessary to protect privacy, safety, security, confidential reports, or an investigation.

A suspended account may remain able to sign in and read certain shared campus content while losing the ability to post, reply, react, report, message, update communication preferences, or perform other write actions. CBU may impose a broader restriction when appropriate.

App restriction is separate from academic, employment, housing, disciplinary, or other institutional status unless CBU expressly states otherwise. Conduct in the App may also be addressed under separate CBU processes.

11. Requesting Review of an Account Action#

Unless a different CBU notice identifies another contact, a user may request review of an App suspension or access restriction by contacting:

The request should include the user's name, CBU email address, a brief explanation, and any relevant date or screenshot. Do not include passwords, verification links, full student ID numbers, or sensitive information that is not needed.

A review request does not automatically pause an action or restore access. CBU may route the request to another authorized office. Any review is subject to applicable CBU policies, privacy and safety limits, legal obligations, and the availability of relevant records. Nothing in this section replaces a formal right or process that applicable law or another CBU policy expressly provides.

12. Account Deletion and Retained Records#

The App may permit a user to request deletion of the user's authentication account and optional user-facing profile. Account deletion is not a way to erase or alter CBU-controlled institutional records.

As explained in the Privacy Policy, CBU may retain roster, student or campus ID, required attendance, points transactions, redemption receipts and summaries, moderation and safety records, administrative audits, and other records needed for campus operations, participant continuity, security, legal compliance, dispute resolution, or an approved retention schedule.

Public content may be hidden and relabeled rather than permanently erased. Messages received by other participants and restricted safety or moderation copies may remain. Suspending or terminating access does not require CBU to delete records.

13. Privacy#

CBU's Privacy Policy describes information practices for the App and is incorporated into these Terms by reference. You are responsible for reviewing it.

Do not use the App to disclose information about another person unless you are authorized to do so. You may not use information obtained through the App for an unauthorized directory, mailing list, solicitation, investigation, background check, surveillance activity, model training, commercial purpose, or public posting.

14. CBU and Third-Party Intellectual Property#

The App, its software, design, branding, logos, text, official content, and other CBU-provided materials are owned by or licensed to CBU and are protected by applicable law. CBU grants no right to use its name, marks, mascot, seals, or branding outside authorized App use.

If you believe content in the App infringes your rights, contact CBU using the information in Section 22 and provide enough information to identify the content and explain the concern.

15. Availability, Changes, and Updates#

CBU may modify, suspend, replace, or discontinue any part of the App. Features may be unavailable because of maintenance, internet or provider outages, device limitations, security actions, or other circumstances.

You may need to install an update to continue using the App. CBU does not guarantee that every feature will always be available, error-free, current, or compatible with every device.

16. No Emergency, Medical, Counseling, or Transaction Service#

The App is not an emergency-alert system, emergency-response service, medical service, mental-health service, confidential counseling service, legal service, financial service, payment processor, or guarantee of a Marketplace exchange.

Do not rely on the App when immediate action is required to protect health, safety, property, legal rights, or a deadline. Contact 911, an appropriate professional, the relevant CBU office, or another authoritative resource.

17. Disclaimers#

To the fullest extent permitted by applicable law, the App and its content are provided on an "as is" and "as available" basis. CBU does not warrant that the App will be uninterrupted, error-free, completely secure, or that all user content will be accurate, appropriate, or available.

CBU does not endorse every statement, listing, prayer request, message, link, or other item submitted by a user. Users are responsible for evaluating user content and interactions.

Nothing in these Terms excludes a warranty, right, or remedy that cannot lawfully be excluded.

18. Limitation of Liability#

To the fullest extent permitted by applicable law, CBU and its trustees, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the App, user content, third-party services, unauthorized access, loss of data, or interactions between users.

Nothing in these Terms limits liability where limitation is prohibited by law. These Terms do not alter rights a user may have under applicable student-record, consumer-protection, privacy, civil-rights, or other law.

19. Responsibility for Your Conduct#

You are responsible for your conduct, User Content, Marketplace exchanges, and violations of another person's rights. To the extent permitted by applicable law and CBU policy, you may be responsible for loss or harm caused by your intentional misconduct, fraud, unauthorized access, infringement, or violation of these Terms.

This section does not create a requirement for a student or employee to indemnify CBU beyond what applicable law and valid CBU policy permit.

20. App Store and Device Terms#

Your use of the App may also be subject to the applicable app store, operating-system, device, and service-provider terms. The App is licensed, not sold.

For an App obtained through Apple's App Store, Apple's then-current standard Licensed Application End User License Agreement and usage rules apply except to the extent CBU has validly provided a separate custom end-user license agreement. Apple is not responsible for operating, supporting, or moderating the App.

For an App obtained through Google Play, applicable Google Play terms and policies also apply. If a mandatory platform term conflicts with these Terms, the mandatory platform term controls only to the extent of the conflict.

21. Dispute Resolution, Arbitration, Class-Action Waiver, and Forum Selection#

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS LEGAL RIGHTS. EXCEPT FOR THE LIMITED EXCEPTIONS BELOW, YOU AND CBU AGREE TO RESOLVE COVERED DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT. YOU AND CBU ALSO WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Informal resolution first#

Before starting arbitration or filing a permitted court action, the person or organization raising the dispute must send the other party a written notice describing the dispute and requested relief. A notice to CBU must be sent to the Student Services postal or email address in Section 22 with the subject line "Legal Dispute Notice." CBU may send notice to the user's CBU email address or most recent contact information.

The parties will attempt in good faith to resolve the dispute informally for at least 30 days after receipt of the notice. A limitations period will be tolled during that 30-day period to the extent permitted by law. Either party may seek urgent temporary relief when waiting would risk immediate or irreparable harm.

Agreement to binding individual arbitration#

Except for the exclusions below, any dispute, claim, or controversy between a user and CBU arising out of or relating to the App, these Terms, the Privacy Policy, User Content, an account, App access or removal, or an App-related interaction or service (a "Dispute") will be resolved by final and binding individual arbitration.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. Arbitration will be administered by the American Arbitration Association ("AAA") under its then-current Consumer Arbitration Rules and Consumer Due Process Protocol, as modified by these Terms. The AAA rules and filing information are available at https://www.adr.org/consumer.

The arbitration will be heard by one neutral arbitrator. Unless the parties agree otherwise, the user may choose a documents-only, telephone, or video proceeding when permitted by the AAA rules. Any required in-person hearing will take place in or reasonably near Randolph County, Missouri, unless the arbitrator, applicable rules, or law requires another location.

Each party may be represented by counsel at its own expense. Filing fees, administrative costs, and arbitrator compensation will be allocated under the AAA Consumer Arbitration Rules and applicable law. CBU will pay amounts the AAA rules or applicable law require CBU to pay. The arbitrator may award any individual remedy available in court under applicable law, but may not award relief for or against a person who is not a party to the arbitration.

The arbitrator will issue a reasoned written decision. Judgment on an award may be entered in any court with jurisdiction. If AAA is unavailable or declines to administer a properly filed arbitration for a reason unrelated to a party's failure to comply with these Terms or pay required fees, the parties will select another nationally recognized arbitration provider or ask a court with jurisdiction to appoint an arbitrator under applicable law. If AAA declines because CBU failed to satisfy an applicable consumer-arbitration requirement, the user may elect to pursue the Dispute in a court with jurisdiction.

Disputes not required to be arbitrated#

Either party may:

  • bring an eligible individual claim in small-claims court;
  • seek temporary or preliminary injunctive relief in court to prevent immediate or irreparable harm while arbitration is pending;
  • bring a claim concerning infringement or misuse of intellectual property, unauthorized access, or compromise of the App or CBU systems when court relief is reasonably necessary;
  • report a matter to law enforcement, a regulator, an accreditor, or another government agency; or
  • use an applicable CBU academic, employment, student-conduct, safety, grievance, or administrative process.

This arbitration agreement does not require arbitration of a claim that applicable law prohibits from being arbitrated. An internal CBU process is not itself an arbitration and does not prevent arbitration or court review when otherwise available under applicable law or CBU policy.

Class, collective, consolidated, and representative-action waiver#

ALL DISPUTES MUST BE BROUGHT AND RESOLVED ONLY ON AN INDIVIDUAL BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER YOU NOR CBU MAY BRING, JOIN, OR PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, COORDINATED, OR REPRESENTATIVE ACTION OR ARBITRATION, OR SEEK RELIEF ON BEHALF OF OTHER USERS OR THE GENERAL PUBLIC.

The arbitrator may not combine claims of different individuals or preside over any class, collective, consolidated, mass, coordinated, or representative proceeding unless all affected parties expressly agree in writing after the Dispute arises.

If a court finally determines that this waiver is unenforceable for a particular claim or request for relief, only that claim or request will proceed in court after all arbitrable matters are completed; it will not proceed in class or representative arbitration. The remainder of this Section will remain effective.

Jury-trial waiver#

FOR ANY DISPUTE THAT IS ARBITRATED, YOU AND CBU KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO HAVE THE DISPUTE DECIDED BY A JUDGE OR JURY IN COURT. For a Dispute properly proceeding in court, any jury-trial waiver applies only to the extent permitted by law.

Right to opt out of arbitration#

A user may opt out of this arbitration agreement and the class-action waiver by sending written notice within 30 days after first accepting the version of these Terms containing this Section. The notice must:

  • state that the user is opting out of the CBU Campus App arbitration agreement;
  • include the user's full name and CBU email address; and
  • be sent from the user's CBU email address to studentservices@centralbible.edu with the subject line "Arbitration Opt-Out", or delivered to the Student Services postal address in Section 22.

An opt-out applies only to the user who timely submitted it and does not affect the remaining Terms. CBU will not restrict App access solely because a user properly opts out. If a user is under 18, CBU may require a parent or legal guardian to submit or confirm the opt-out where required by law.

Forum selection for court proceedings#

Any Dispute that is excluded from arbitration, validly opted out of arbitration, or finally determined not to be arbitrable must be brought exclusively in the state courts located in Randolph County, Missouri, or, when federal subject-matter jurisdiction exists, the United States District Court for the Eastern District of Missouri, Northern Division. You and CBU consent to the personal jurisdiction of those courts and waive objections based on venue or inconvenient forum, except where applicable law does not permit that waiver.

Governing law#

These Terms are governed by the laws of the State of Missouri and applicable federal law, without regard to conflict-of-law principles, except where another law must apply. The arbitration agreement is governed by the Federal Arbitration Act.

Severability#

Except as specifically provided for the class-action waiver above, if a provision of these Terms is found unenforceable, it will be enforced to the greatest extent permitted or removed to the minimum extent necessary, and the remaining provisions will continue in effect.

CBU's failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.

23. Changes to These Terms#

CBU may update these Terms when the App, campus services, policies, platform requirements, or law changes. CBU will update the "Last updated" date and provide notice appropriate to the significance of the change.

CBU may require you to review and accept revised Terms before continuing to use the App or before using communication and upload features. If you do not accept revised Terms, you must stop using the affected features or the App.

24. Entire Agreement#

These Terms, the Privacy Policy, and applicable CBU policies form the agreement governing App use. They do not modify an enrollment agreement, employment agreement, student handbook, or other CBU agreement except where an authorized CBU document expressly says so.

User Acknowledgment#

By selecting "I Agree", creating an account after these Terms are presented, or continuing to use the App after being required to review updated Terms, you acknowledge that:

  • you had access to and an opportunity to read these Terms and the Privacy Policy;
  • you understand that objectionable content and abusive conduct are prohibited;
  • you understand that users can report content and block users through available App controls;
  • you understand that CBU may hide content, restrict features, make an account read-only, suspend access, or remove access as described above;
  • you understand and agree to the individual arbitration requirement, jury-trial waiver, class-action waiver, and forum-selection provisions in Section 21 unless you timely exercise the stated arbitration opt-out right;
  • you understand that App account deletion does not erase CBU-controlled institutional records; and
  • you agree to comply with these Terms and applicable CBU policies.
